Another benefit of having the approval of an attorney prior to signing any legally binding or contractual agreement is that it automatically imposes a “cooling-off period,” by allowing the seller to have more time to think it over before committing.

This is exactly what experts recommend, particularly for senior citizens, who are often victimized as a result of pressure imposed by “sales tactics.”

How Are The Attorneys Selected?

Attorneys on the list are selected based on their experience in real estate and their knowledge of, and familiarity with, the real estate forms prepared by the California Association of Realtors; these forms are typically used in most real estate transactions.

Attorneys on the list must also agree to a pre-negotiated fixed price to provide the services described above. Attorneys do not pay to be on the list nor does Right Home® pay the attorneys on the list in any way. The goal is to eliminate conflict of interest.

How Are the Attorneys Paid?

Attorneys have fiduciary duties and obligations to those who pay them. In order for the client to have legal representation, the attorney must be paid directly by the client; Right Home® will credit the client at the close of escrow, just when the attorney will be paid.

When the senior client does not have the financial ability to pay the attorney prior to the close of escrow, the attorney will wait until the close of escrow in order to be paid from the proceeds of the sale of senior’s property. This is one of our preconditions with the attorneys on the list and, thus, benefits seniors.

In order to make sure that these attorneys truly remain independent and not reliant on Right Home’s referrals, we implemented another guideline. Right Home clients should never represent more than 20% of their business so they can maintain their independence.

Additionally, the fees they receive on senior citizen cases are just enough to give them a small steady side income but not enough to grow a business solely relying on it.
